1) Agreement & Scope
These Terms of Service (“Terms”) are a binding agreement between you and the operator of OnlineSpeedTestService.com (“we,” “us,” “our”). By visiting the site, running tests, creating an account, or using any feature, you agree to these Terms.
2) Eligibility
You must be 13+ (or your state’s higher digital-consent age). If you accept for an organization, you confirm you have authority to bind it.
3) What the Service Does
We provide tools to measure and visualize network performance (e.g., download/upload throughput, latency, jitter, packet loss), surface network metadata (e.g., public IP/ASN/approximate location), and offer troubleshooting tips. Results vary with device, browser, Wi-Fi/ethernet, VPNs, server distance, congestion, and ISP policies. Confirm critical outcomes with your ISP’s official tools or professional diagnostics.
4) Accounts & Security (if offered)
Keep information accurate. You’re responsible for activity on your account and safeguarding credentials. Notify us promptly of unauthorised use. We may suspend or terminate accounts to protect users or comply with law.
5) Acceptable Use
You agree not to:
submit or distribute unlawful, infringing, deceptive, or harmful content;
spoof traffic/agents, manipulate tests, or interfere with the test network;
scrape/mirror at scale contrary to robots.txt or any published API/rate limits;
probe, bypass, or disrupt security; introduce malware; overload servers; misuse any API.
We may apply rate limits, anomaly detection, takedowns, suspensions, and bans. We may preserve and disclose information where required by law or to protect users/service integrity.
6) Additional services, offers, and promotions
ADDITIONAL SERVICES, OFFERS, AND PROMOTIONS
When you use our services provided herein and in connection with our products, you may encounter additional services, offers, and promotions such as affiliate promotions, sponsored content (including online advertising), optional features. By using our site, products and services, you acknowledge and accept these services, offers, and promotions, as described in this Agreement and our Privacy Policy.
7) User Content & Feedback
You retain ownership of content you submit (e.g., comments, reviews, support messages). You grant us a worldwide, non-exclusive, royalty-free licence to host, process, display, adapt (formatting/accessibility/SEO), and distribute such content to operate and improve the service. Feedback may be used without restriction or obligation.
8) Intellectual Property
We own the site, software, UI, databases, test methodologies/visualisations, and branding. Subject to these Terms, we grant you a limited, revocable, non-transferable, non-exclusive licence to use the service for personal or internal business use. Third-party marks/content remain with their owners.
9) Paid Features & Refunds (if applicable)
We may offer premium features (e.g., results history, scheduled tests, ad-lite mode, advanced exports/API). Prices and auto-renewal terms are shown at checkout. Subscriptions auto-renew until you cancel; access continues through the current paid term. Refunds: delivered digital services are generally non-refundable unless required by law or for a verified delivery failure (contact support within 14 days). We may suspend accounts during fraud/chargeback investigations.
10) Third-Party Services
We may use or link to third-party test servers, CDNs, analytics, advertising/affiliate networks, payment processors, or app stores. Their terms and privacy policies apply; we don’t control or endorse third-party content.
11) Disclaimers
THE SERVICE AND ALL CONTENT/RESULTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. Test results are indicative, not guarantees of ISP performance or device capability.
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES/EMPLOYEES/PARTNERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOST PROFITS, DATA, OR GOODWILL. WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF USD $50 OR THE AMOUNTS YOU PAID TO US IN THE 6 MONTHS BEFORE THE CLAIM.
13) Indemnity
You agree to defend, indemnify, and hold us harmless from claims arising out of your misuse of the service, your content, or your breach of these Terms or law.
14) Disputes — Arbitration & Class-Action Waiver (U.S.)
You and we agree to resolve disputes individually by binding arbitration administered by the AAA (Consumer Rules) under the Federal Arbitration Act. Class actions and jury trials are waived.
Opt-out: email support@onlinespeedtestservice.com within 30 days of first acceptance (subject: “Arbitration Opt-Out”).
Carve-outs: either party may seek injunctive relief in court to protect IP or stop misuse. If a claim must be litigated, both parties consent to exclusive jurisdiction in New Castle County, Delaware, under Delaware law.
15) Changes; Export/Sanctions; Misc.
We may update features or these Terms; material changes will be posted, and continued use after they take effect means acceptance. You confirm you’re not on U.S. sanctions lists and won’t use the service in violation of export/sanctions laws. If any term is unenforceable, the rest remain in effect. You may not assign these Terms without our consent.
